H-1B CAP COUNT UPDATE
October 25, 2009 H-1B Cap Count Update
As of October 25, 2009, approximately 52,800 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. Any H1-B petitions filed on behalf of an alien with an advanced degree will now count toward the general H1-B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.

EB-5 (INVESTORS VISA) PROGRAM IS EXTENDED UNTIL SEPTEMBER 30, 2012
On 10/13/09, the House and Senate Appropriations Committees issued a conference report on the FY 2010 Homeland Security Appropriations bill (H.R. 2892/S.1298). EB-5 visa program is extended through September 30, 2012.

The Department of State announces the opening of the registration period for the DV-2011 Diversity Visa lottery. Entries for the DV-2011 Diversity Visa lottery, entries must be submitted electronically between noon, Eastern Daylight Time (EDT) (GMT-4), Friday, October 2, 2009, and noon, Eastern Standard Time (EST) (GMT-5), Monday, November 30, 2009. Applicants may access the electronic Diversity Visa entry form (E-DV) at www.dvlottery.state.gov.
