EB-5 Program Legislation Update - 17/12/2015

After several rounds of legislative negotiations that have been unfolding over the last several months regarding the future of the EB-5 program, the U.S. Congress has decided to simply extend the EB-5 program, without any changes, through September 30, 2016.

NOTICE TO THOSE HIRING H-1B TEMPORARY WORKERS - 14/12/2015

The new year is almost upon us, and that means that employers seeking to hire foreign employees need to start planning to file H-1B petitions. H-1B status is an employment-based temporary immigration status that allows its holders to work in the U.S. It applies to "specialty occupations," which includes most high-skilled positions. It is a sponsor-based status, which means that an employer must file for H-1B status for a foreign national- a foreign national cannot apply on their own, without an employer sponsoring him or her.

Proposed changes to EB-5 program - 18/11/2015

The draft of the most prominent EB-5 bill currently being considered in Congress was recently released to members of the EB-5 community. Since it is only a draft, there are no guarantees that any provision currently included will necessarily remain in the final bill and become enacted law, especially since there is strong opposition to several of these provisions.

Please be advised that Congress has extended the EB-5 program without any changes until December 11, 2015. - 02/10/2015

Based on the proposed legislation, we anticipate that there will be substantial changes as proposed by Senators Leahy and Grassley. The current extension until December is merely a reflection of the fact that Congress could not agree on the specifics of what changes to make to the EB-5 program. It does not indicate that the program will remain unchanged beyond December 11, 2015. We will continuously monitor the situation and provide periodic updates on changes to the EB-5 program.
