· Methodology used for job creation
· Does the program create direct, indirect or induced jobs
· What is the likelihood that the investment program will last for at least 5 years
· Developer’s prior track record
· Area consideration for EB-5 investment
· USCIS regulations provide that Developer may not substantially change the business plan that was initially submitted in order to receive approval for regional center designation
· EB-5 Investor should carefully select immigration counsel and investment advisor in order to review the EB-5 regional program offering
· Over aggressive estimates of job numbers creation by Developer
